Haus of Portraiture Teams & Conditions

Outside cameras, including smart phones, tablets or otherwise, as well as any other recording devices are not permitted to be used for recording or photographing at your session. We kindly ask that this policy is also shared with your spouse, partner and any guest that will be joining you in studio. Thank you in advance for understanding that this is not a negotiable policy.

DRESS CODE:

Because this experience is such a special event, and we encourage our clients to treat it as such. Our Dress Code requires that all clients come dressed in the specifications of the Dress Code listed on the website. Clients in an inappropriate wardrobe will be required to reschedule. Clothing that is inappropriate includes but is not limited to: ripped jeans, shorts, t-shirts, sweatshirts, sneakers, khaki’s and workout attire of any kind.

PARTIAL FAMILIES:

We do not photograph ‘incomplete families,’ where one family member is not able to attend the portrait session but wants to attend at another time. We are more than happy to reschedule a new appointment for you when you are all together.

Haus of Portraiture reserves the right to refuse service if the entire family does not attend the photo session and design session. Haus of Portraiture requires both parents (when applicable) to attend the session.

GIFT CERTIFICATES:

Must be redeemed by the gift certificate recipient prior to the expiration date, provided the recipient has not redeemed a Competition Prize or Gift Certificate with Haus of Portraiture in the last 24 months (date calculated from the previous sitting date) Prizes are for studio portraiture and cannot be used for other types of photography.  One certificate per household. Certificates cannot be combined.

DIGITAL FILES:

Under the copyright laws of the United States, Haus of Portraiture is the copywriter owner of all images taken at the Haus of Portraiture studio located at 725 Arizona Ave., Suite 103, Santa Monica, CA 90401. Therefore, Haus of Portraiture reserves the right to obtain all images and does not outright sell or give away digital file images from any and all sessions and it is at their absolute discretion whether or not they choose to do so.

APPOINTMENT HOLDING DEPOSITS

A deposit will be required to secure and hold your appointments. This holding fee ensures your commitment to the scheduled appointments.

The deposit will be refunded at your Design Session appointment (if applicable), provided you have completed both your Photography Session and Design Session appointment at the correctly scheduled time and date. Failure to attend or complete your scheduled appointment will result in the cancellation of any prize and the forfeiture of the holding fee.

If you are 15 minutes late or more, we may not be able to see you for your appointment and your deposit will be forfeited.

ATTENDANCE:

We reserve 2 hours for your session. Please arrive approximately 10-15 minutes before your session start time. A late start will result in a shorter photography session and/or may be required to reschedule for another day.

Your portrait session is the first and only time you will see your portraits. So, all decision makers need to be present. Your images are retired after this appointment and no longer available again. All orders are also finalized during this time and cannot be changed, modified, or canceled.

NO-SHOW POLICY:

A “No-Show” is considered when an individual, family or couple simply does not show up to their dedicated session time, nor cancels or calls to tell the studio they are no longer coming. All No-Shows will automatically be charged an additional $150 fee.

RESCHEDULING:

If you are unable to keep your appointment, you must let us know at least 14 days before your session. You may only reschedule your session once, after which your deposit is forfeited and nonrefundable.

TREATMENT OF REVERSALS AND CHARGEBACKS:

Intentional credit/debit card reversals and chargebacks are frequently indicators of possible fraudulent use and/or theft of our services and we will treat them as such. We reserve the right to investigate further and file complaints with the appropriate local and federal authorities. Please be advised that we regularly monitor all internet protocol address information and other user activity and that this information may be used in a civil and/or criminal case against any customer, especially in instances of possible theft or fraudulent behavior.

INDIVIDUAL CHILDREN/PET PORTRAITS:

Children and Pets can be photographed separately from their parents/pawrents AFTER the entire family has been photographed together. Children and Pets photograph more naturally and relaxed after they’ve warmed up to the process with their parents/pawrents first. Please make sure the entire family is prepared and dressed for the session.

TRANSFERABLE:

Prizes and Gift Certificates are NON-transferable. They are not exchangeable or redeemable in whole or in part for any cash equivalent. The certificates and gift certificates cannot be used in conjunction with any other offer, prize, or promotion. Only one (1) Gift Certificate or Prize certificate can be used at a time.  You cannot use the gift certificate or prize certificate to purchase products from any other photo sessions or toward framing.

FACEBOOK/INSTAGRAM (META) PROMOTIONS:

By submitting a META application, the entrant acknowledges that the promotion is in no way sponsored, endorsed, administered by or associated with, Facebook or Instagram in any way. Selections are made on a weekly basis and not limited to any number of selections on a given basis. We reserve the right to select and gift applicants daily/weekly/monthly.

NON-DISPARAGEMENT:

Each party, their agents, servants, associates and employees, agree not to make any disparaging statements regarding any other party to any third persons or entities. Client agrees not to disparage or denigrate the company orally or in writing, and that neither they nor anyone acting on their behalf will publish, post, or otherwise release any material in written, electronic, or oral format, that mention the company, its operations, clients, employees, products, or services without the prior written consent of the company. Any current postings or publications of any kind, will be removed immediately. If breached, Company will file an injunction to force removal and party will be responsible for attorney fees.

ARTISTIC CONTROL:

Haus of Portraiture reserves artistic control over the design and content of each session. We may, at our discretion, decline to create certain types or styles of photography. We reserve the right to refuse to produce images at some sizes or combinations of sizes if we believe such images would or could be detrimental to our reputation as a professional studio or as professional photographers.

REFUSAL OF SERVICE:

Haus of Portraiture reserves the right to refuse service if in our opinion the provision of service is likely to cause or has caused disruption to either staff members or the normal operation of business.

APPOINTMENT RESCHEDULE POLICY:

Gift Certificates and Prize certificates entitle the holder to a SINGLE APPOINTMENT ONLY. Once made, an appointment cannot be rescheduled, and the Gift Certificate or Promotional Certificate is deemed to have been used in full at that original appointment time and date.

*NOTE: In exceptional circumstances, management may, at their sole discretion, reschedule an appointment and carry forward the Gift Certificate and holding fee / deposit.

EXTENDED FAMILY POLICY:

Extended families are deemed to be groups larger than 8. Different prices apply so please contact the studio for a current quote. Extended family bookings are taken at the discretion of the photographer and require an in-studio consultation to make a booking. Prize certificates are not available for extended family sessions.

COPYRIGHT:

Unrestricted Copyright to all images created during the photo shoot that forms part of the Gift Certificate or Prize certificate is deemed to belong solely to Haus of Portraiture

REFUNDS:

We take great pride in creating custom bespoke artwork that is tailored specifically to our clients' needs. As a valued customer, we want you to be completely satisfied with your order. Under California Consumer Law there is no cooling off period and a no refund policy. Depending on the type of session, replacement portraits and additional studio credit may be awarded (as is deemed necessary by the staff and client).

FOR ALL GIVEAWAYS AND GIFT CERTIFICATE HOLDERS:

·      A $300 deposit secures your portrait session for the date/time agreed upon. Your deposit is refunded on the day of your session.

·      Both parents (if applicable) must attend the photography session and design appointment for any offers or gift vouchers to be valid.

·      Session must be booked prior to expiration date written on gift certificate and undertaken within 3 months.

·      Only one gift certificate per family may be used.

·   All sessions must be photographed, designed and completed at and by Haus of Portraiture at (studio) 725 Arizona Ave., suite 103, Santa Monica, CA 90401. Any portraits needing to be recreated or “reshot” whether partial or in full will also be remade at the aforementioned studio and address.

·      Offers may not be used in conjunction with any other offer or voucher and is not redeemable for cash or any other goods and may only be used as described.

·      Offers are non-transferable.

·      Special offers cannot be used to purchase portraits from a previous portrait session.

·      At least 14 days is required if you need to change your appointment for your session. Failure to do so may result in loss of any special offers or promotions.

·      Any gifts or special promotions are only redeemable at your portrait session.
